We know you'd rather be on the water than reading legal print, but there are some things we must tell you. We've tried to be brief and clear - here goes:
This bit is easy: by creating a Dockside account, you're acknowledging that you have read and agree with these terms. If you don't agree, you are not permitted to use our service.
We may update these terms from time to time to respond to changes in the law or The Service itself. We'll be sure to notify you of any significant changes in advance.
To make sure we're all on the same page, here are a few terms we use:
We grant you permission to use The Service for its intended purpose: managing sailing and racing activities. In return, you agree to:
Do: Keep your password safe and secure; what happens on your account is your responsibility.
Do: If you have admin rights for a club, confirm you're authorised to act on its behalf.
Don't: Use The Service for any illegal purpose, or to harass, abuse, or harm other users.
Don't: Attempt to gain unauthorised access, interfere with the service, or transmit any viruses.
Don't: Scrape, copy, or resell Our Content or any data from The Service without our permission.
This is simple: You own your content. We own ours.
You retain full ownership of all "Your Data" and "Club Data" you upload. By using The Service, you grant us a necessary, non-exclusive licence to store, process, and display that content to provide the service to you and your club.
Please note: We also have agreements in place with the clubs themselves. Therefore, some of your data may be provided to us through your existing relationship with your club, by extension of those agreements between the club and Dockside.
We retain full ownership of The Service, our logos, our code, and all intellectual property associated with Dockside. You may not copy or re-use our code or design without our explicit permission.
Okay, this part is important. Dockside is designed to be a powerful aid, but it is not a substitute for official race governance.
You must follow your club's official rules. Information on Dockside (timings, scoring, notices) is for convenience. The official club notice board and the decisions of the Race Committee are always the final authority.
You use The Service entirely at your own risk. It is provided "as-is" without any warranty, express or implied. We do not guarantee it will be uninterrupted or error-free.
We accept no liability for navigational errors, incorrect race results, missed sign-ons, or any damage to any boat or person. To the maximum extent permitted by law, Dockside shall not be liable for any indirect, incidental, or consequential damages. Where we are not legally able to exclude liability, our total liability is limited to £1.00.
For now, Dockside is free to use. As The Service grows, we may introduce subscription plans for clubs and associations. If this happens, we'll provide the clubs and associations at least one month's notice.
You can ask to close your account at any time by contacting us. We reserve the right to suspend or terminate your account if you breach any of these terms.
If your use of The Service or your violation of these terms creates any legal claim or costs against us, you agree to indemnify and hold us harmless from those claims and expenses (including legal fees).
Our agreement with you is governed by the laws of England and Wales. Any legal proceedings must take place in the courts of England. These terms, along with our Privacy Policy and Cookie Policy, form the entire agreement between us.
